Terms of Service — The Collectibles Marketplace

1. Acceptance of Terms

By accessing or using Vaultr ("the Service," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, you must not use the Service. These terms constitute a legally binding agreement between you and Vaultr.

2. Eligibility & Age Verification

You must be at least 18 years of age to create an account, make purchases, or use any feature of Vaultr. By using the Service, you represent and warrant that you are at least 18 years old. We reserve the right to request proof of age at any time and to suspend or terminate accounts where age requirements are not met. Vaultr does not knowingly collect information from or market to individuals under the age of 18.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

Provide accurate, current, and complete information during registration
Keep your login credentials secure and not share them with others
Notify us immediately of any unauthorized access to your account
Not create multiple accounts for the purpose of abusing promotions or platform features

We reserve the right to suspend or terminate accounts that violate these responsibilities.

4. Nature of Products & Purchases

Vaultr sells mystery packs containing real, physical, professionally graded Pokemon trading cards. Each pack purchase is a final sale of a physical product. Key disclosures:

Physical goods: Every mystery pack contains one or more real, graded Pokemon cards that exist in our secure storage at the time of purchase. You are purchasing a tangible product, not a chance or wager.
Random determination: The specific card you receive from a pack is randomly determined at the time of opening using a cryptographically secure randomization process. You always receive a card of real market value.
Guaranteed value: All cards included in any pack have verifiable market value. No pack contains cards with zero value.
Odds disclosure: The odds of receiving each card (or card tier) are clearly disclosed on the individual pack product page before purchase. We encourage you to review these odds before buying.
Final sale: Because a specific card is assigned upon opening, mystery pack purchases are final and non-refundable. You always receive a product in exchange for your payment.

5. Pricing & Payment

All prices are displayed in the applicable currency at checkout. Applicable taxes (including sales tax and provincial/state taxes) are calculated and added at checkout based on your location. All payments are processed securely through Stripe. Vaultr does not store your payment card details.

6. Vault Storage & Card Custody

Cards you own through Vaultr are stored in our secure facility. While cards remain in storage:

You retain full ownership of your cards at all times
We take reasonable precautions to protect cards against loss, theft, and damage
You may request physical redemption (shipping) of your cards at any time
You may list your cards for sale on the Vaultr marketplace

7. Card Redemption & Shipping

You may redeem any card in your vault for physical delivery at any time. Shipping costs are calculated at checkout based on destination and selected carrier. Cards are shipped in protective packaging suitable for graded cards. Once a card is shipped, risk of loss transfers to you upon delivery to the carrier. We are not responsible for delays caused by postal or courier services, customs processing, or events beyond our control.

8. Buyback Program

Vaultr offers an optional buyback at 90% of the card's current market value, issued as store credit. Important details:

The buyback is entirely optional and is not a refund mechanism
Buyback is offered at the time of pack opening and may also be requested later, subject to current market values
Once accepted, the card is returned to Vaultr's inventory and store credit is applied to your account
Store credit is non-transferable and has no cash redemption value
Store credit does not expire and can be applied to any purchase on Vaultr

9. Marketplace

Vaultr provides a marketplace where users may list and sell cards they own. By listing a card for sale, you represent that you are the rightful owner of the card. Vaultr may charge a transaction fee on marketplace sales, which will be disclosed before listing. Marketplace transactions are between users; Vaultr facilitates the transfer but is not a party to the sale beyond providing the platform and custody transfer.

10. User Responsibilities

By using Vaultr, you agree to:

Use the Service only for lawful purposes and in accordance with these Terms
Not attempt to manipulate, exploit, or interfere with the randomization process
Not use bots, scripts, or automated tools to interact with the Service without prior written consent
Not engage in fraudulent activity, including but not limited to payment fraud or chargeback abuse
Not harass, threaten, or abuse other users or Vaultr staff
Not misrepresent your identity, age, or any information provided to Vaultr
Comply with all applicable local, state, provincial, and federal laws

11. Intellectual Property

The Vaultr name, logo, website design, and original content are the property of Vaultr. Pokemon is a trademark of Nintendo / The Pokemon Company. Vaultr is not affiliated with, endorsed by, or sponsored by Nintendo or The Pokemon Company. All card images and trademarks belong to their respective owners.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

Vaultr's total liability for any claim arising from or related to the Service shall not exceed the amount you paid for the specific product or transaction giving rise to the claim
Vaultr is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill
Card market values fluctuate. Vaultr does not guarantee, warrant, or represent the current or future market value of any card
Vaultr is not liable for losses resulting from unauthorized access to your account caused by your failure to secure your credentials

13. Dispute Resolution

If you have a dispute with Vaultr, we encourage you to contact us first at [email protected] so we can attempt to resolve the issue informally. We are committed to resolving disputes in good faith.

If we are unable to resolve a dispute informally within 30 days, either party may pursue resolution through binding arbitration administered by a recognized arbitration body, rather than in court. Both parties waive the right to participate in a class action lawsuit or class-wide arbitration. Small claims court actions are exempt from this arbitration requirement.

Any dispute shall be governed by and construed in accordance with applicable laws (see Section 15).

14. Indemnification

You agree to indemnify, defend, and hold harmless Vaultr, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

15. Governing Law

These Terms shall be governed by and construed in accordance with the applicable laws of the jurisdiction in which Vaultr operates, without regard to conflict of law principles. You agree to submit to the personal jurisdiction of the courts located in such jurisdiction for the resolution of any disputes not subject to arbitration.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service. Your continued use of Vaultr after changes are posted constitutes your acceptance of the revised Terms. If you do not agree with any changes, you must stop using the Service.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
